Planning

The Department of Planning and Development serves the community by guiding responsible growth and development, coordinating land use decisions, and fostering a sustainable, well-planned community for current and future residents. In this capacity, the department informs and educates the public in the following areas: 

  • Permitting for Land Disturbances and Floodplains 
  • Planning and Land Use Studies 
  • Development Proposals 
  • Coordination and Collaboration with Local and State Agencies 
  • Subdivisions (Planning Board)
  • Site Plans (Planning Board)
  • Area and Use Variances (Zoning Board of Appeals)
  • Special Permits (Zoning Board of Appeals)

The Commissioner of Planning and Development prepares and coordinates petitions for review by the Planning Board, Zoning Board of Appeals, and the Town Board, ensuring that applications are complete, accurately documented, and ready for consideration. 

Please Note - Application Submission Procedures

The Planning Department is currently in the process of updating its application packets and submission requirements to improve efficiency and eliminate unnecessary materials. During this transition, we are providing the following guidance to assist you in preparing and submitting applications.

Pre-Application Coordination

Applicants are required to contact the Planning Department to schedule a pre-application meeting or call prior to submitting any materials. This step is essential to discuss the project scope, applicable review process, and anticipated timeline. Any application submitted prior to this coordination may be held until such discussion occurs.

Application Submission Process

Applications may be submitted by mail or in person. For in-person submissions, applicants will be asked to wait briefly while staff reviews the submission to confirm completeness. This review will verify that all required forms and supporting documentation are included, the correct number of copies has been provided, electronic files (flash drive or digital submission) are included, and the appropriate application fee has been submitted. Only one complete original copy is required, which must include a signed affidavit, legal description, and deed.

  • Please note the Planning Department will not accept and/or process an application packet until it complies with all these requirements.

Submission Requirements by Application Type

To ensure timely processing, please provide the following number of copies for each application type:

  • Town Board:

Twenty copies (application form, EAF, survey, and required plans and/or zoning maps).

  • Planning Board:

Twelve copies (application form, EAF, survey, and required plans).

  • Zoning Board of Appeals:

Eight copies (application form including variance criteria, EAF, survey, and required plans).

  • Administrative:

One copy (application form, EAF, survey, and required plans).

  • SWPPP:

A completed Land Disturbance Application with the required fee.

Application Review and Determination of Completeness

Following submission, Planning Department staff will issue a completeness determination via email. Applications deemed complete will be scheduled for the next available meeting, as applicable.

If an application is determined to be incomplete, staff will provide written notification outlining the outstanding items required before the application can proceed.

The Planning Department appreciates your cooperation during this update process. These procedures are intended to streamline application review and ensure a more predictable and efficient process for all applicants.

The Town of Clay acknowledges your request to obtain materials submitted by consultants retained by Micron in support of their proposed semiconductor manufacturing facility at the White Pine Commerce Park. The Town is committed to processing such requests in a timely and consistent manner. At present, the Planning and Development Department can provide these materials in a digital format through a secure file transfer or on a flash drive. The Department is available to assist with coordinating the delivery of these files. Looking ahead, the Town will be exploring additional options to make project materials more readily accessible to the public. These options may include the development of an online portal or other electronic methods for document sharing. The Town appreciates your patience and remains committed to ensuring transparency and access to project information.
